Who it is and isn't right for

Suitable

  • Buying an apartment to live in or rent long-term
  • Willing to work with a licensed operator for nightly rentals

Not suitable

  • You need to own land or a villa outright
  • Your strategy depends on nightly rentals without a license

What we check for each project: Check the available quota in the building, the project's hotel license, and payment protections in the contract.

Foreign buyers

Can a foreigner buy property in Thailand

Yes. A foreigner can buy a condominium unit freehold, within the 49% foreign quota of the building's floor area. Villas and land - only through leases of up to 30 years.

The key is the transfer. Payment must arrive from abroad in foreign currency with the purpose stated, and the bank issues a confirmation (Foreign Exchange Transaction Form). Without it, the unit cannot be registered to a foreigner, so we agree the payment route before the reservation.

Visa. The purchase itself does not grant residence.

This is general information, not legal advice. Before the reservation we check the terms for your passport with a lawyer in the country of purchase.

Can you buy remotely?

You can complete a purchase remotely using a power of attorney. Usually, one step still requires you to be there in person: signing it at a notary's office or consulate in your country.

Thailand

Yes. A representative acting under a power of attorney can register the title transfer at the Land Department. The official requirements include the power of attorney and the representative's documents (thailand.go.th). Land offices require their prescribed power of attorney form, signed abroad and certified (NYC Legal).

Important: Payment for a condominium must arrive from abroad in foreign currency, with the purpose of the transfer stated. The bank issues a Foreign Currency Transaction Form as proof. Without it, the unit cannot be registered in a foreigner's name (thailand.go.th).

This is general information, not legal advice. Have a lawyer or notary in the country where you are buying confirm the power of attorney form, translation and apostille before you transfer any money.

You transfer the funds for the property to the developer or into an escrow account under the contract - never to an agency.

Questions about buying

Can a foreigner buy an apartment in Thailand?

Yes, you can own an apartment in a condominium outright if foreign ownership in the building does not exceed 49% of its floor area. The purchase funds must come from abroad in a foreign currency (Condominium Act, checked September 14, 2026).

What about a villa or land?

Foreigners cannot own land. Villas are available through a lease of the land, for a maximum of 30 years (Department of Lands). The Supreme Court ruled that automatic "30+30" extensions are invalid (Addleshaw Goddard).

Can I rent it out by the day?

Renting out a property for less than 30 days without a hotel licence is illegal (Library of Congress). If your strategy involves nightly rentals, we check whether the project has a licence or works with a licensed operator.

What are the purchase costs?

The registration fee is 2% of the appraised value, with the split agreed in the contract. There is also a 0.5% stamp duty or the seller's specific business tax (The Nation, Revenue Department).

Are funds protected during construction?

Escrow is not mandatory for off-plan purchases (Escrow Act). We therefore build protection into the contract and select developers with completed projects.
